Mainpuri, Uttar Pradesh – In a troubling incident that has stirred social tensions in Uttar Pradesh, a Dalit woman in Gamanigaon village under Kishani police station of Mainpuri district has filed a police complaint under the SC-ST (Prevention of Atrocities) Act and other serious IPC sections against members of the Kshatriya community. However, emerging video footage appears to contradict her claims, raising serious questions about the authenticity of the complaint and bringing to light the sensitive issue of fake SC-ST cases in India.
Viral Video Raises Questions Over Woman’s Allegations
A video that has now gone viral on social media platforms shows the same woman who is the primary complainant in the FIR actively damaging the wall herself. In the footage, she is seen breaking the boundary wall of her own premises using tools, with no visible signs of threat, coercion, or interference from the accused individuals.
This footage has become a central piece of evidence that community members claim proves the falsity of the allegations. Supporters of the accused say that the video exposes a misuse of legal provisions meant to protect vulnerable communities, turning them instead into tools of vendetta and harassment.
FIR and the Charges Filed
According to the FIR lodged at Kishni police station, the woman alleged that several upper caste men from the Kshatriya community threatened her life, used casteist slurs, and destroyed her property, invoking the SC-ST Act and other serious IPC sections such as section 147 (rioting), section 506 (criminal intimidation), and section 427 (mischief causing damage).
However, the accused individuals have strongly denied all allegations, stating that no such incident occurred and that the entire complaint is fabricated. They claim that the woman had a long standing property dispute with them and used the fake SC-ST case to settle scores.
Misuse of the SC-ST Act: A Growing Concern?
This case has reignited the national debate about the abuse of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, which was designed as a safeguard for marginalized communities but is increasingly under scrutiny for misuse in personal or political vendettas.
Legal experts and social commentators argue that while the law remains a vital tool for justice, instances of fake SC-ST cases damage the credibility of genuine victims and undermine the trust in the legal system.
“Each fake SC-ST case is not just a false complaint it’s a blow to the integrity of the justice system and a setback for real victims who rely on these laws for protection,” said retired judge.
Caste Tensions Flare in Gamanigaon
The incident has also exacerbated caste tensions in Gamanigaon, a village already known for its social fragmentation along caste lines. Locals report that the community is now deeply divided, with both sides accusing each other of instigating conflict.
Kshatriya community members have staged a peaceful sit in near the Kishni tehsil, demanding a fair investigation and the withdrawal of false charges. They have also submitted a memorandum to the District Magistrate, along with the video footage, urging officials to review the case impartially.
Social media platforms have exploded with opinions on the matter. While some users emphasize the importance of believing marginalized voices, others demand stricter penalties for filing fake SC-ST cases, which they argue undermine the core purpose of the law.
This incident is not isolated. Over the past few years, multiple reports have emerged from across India about fake SC-ST cases being used to harass opponents in land disputes, personal vendettas, or political feuds. The Supreme Court of India, in its landmark 2018 ruling, had even noted the need to prevent misuse of the Act while ensuring it continues to protect the oppressed.
Nevertheless, the delicate balance between protection and misuse remains a tightrope walk for lawmakers and law enforcers alike.
As the investigation unfolds in Gamanigaon, all eyes are now on the police and judicial system to objectively assess the video evidence and ensure that truth prevails. Whether the case proves to be a genuine instance of atrocity or a calculated misuse of legal safeguards, the outcome will have significant implications for both the SC-ST Act and inter community relations in rural India.
