SC/ST Act Misuse in Rae Bareli: Brahmin Man Dies After Dispute
Source & Credits: Third Party

Rae Bareli, Uttar Pradesh – A case from Rae Bareli’s Salon region (Kanahpur, Karahiya Bazar) has sparked widespread outrage over the alleged SC/ST Act misuse, resulting in the death of a Brahmin man named Brijesh Pandey. What began as a land dispute has now turned into a social justice battle, as the victim’s family and local communities demand action against the accused and fair investigation from the police.

Land Sale Turns Into Legal Nightmare

Brijesh Pandey, a resident of Karahiya Bazar in Salon, had sold a piece of land for ₹1.5 lakh to Rakesh Saroj, a Dalit man (Scheduled Caste). However, the buyer only paid ₹75,000 at the time of sale and promised to pay the remaining ₹75,000 later. When Brijesh Pandey started following up for his dues, Rakesh Saroj allegedly started avoiding him.

In a shocking turn, Rakesh Saroj filed a case under the SC/ST Act against Brijesh Pandey and his son Abhishek Pandey, which the family claims was entirely fabricated. Locals and relatives argue that this is a classic example of SC/ST Act misuse, where false allegations are weaponized to pressurize upper caste individuals.

Compromise Agreement and Further Exploitation

After the SC/ST case was filed, Rakesh Saroj allegedly pushed for a compromise, demanding an additional 11 biswa land agreement from the Pandey family. However, that land was already under a bank loan, making the transaction legally impossible.

Despite that, Rakesh continued to pressure Brijesh Pandey through threats and alleged intimidation. The mental stress from these events reportedly led to Brijesh Pandey’s untimely death, which the family believes was caused by persistent psychological torture stemming from the SC/ST Act misuse.

Police Action Under Question

Following public outrage and a local protest at the police outpost, a case was finally registered against Rakesh Saroj. However, rather than investigating him, the local police began harassing the deceased’s son, Abhishek Pandey, the family claims.

Abhishek provided clear evidence proving he was not present at the time or place of the alleged SC/ST incident mentioned in the FIR. However, the police are reportedly proceeding to file a chargesheet against him under the same law a move criticized as biased and unjust by community members and civil rights activists.

District Police Officer’s “Abusive Response” to Inquiry

In a bold move, Sudhir Tiwari, the district president of Rashtriya Savarna Parishad (RSP), attempted to contact the area’s Circle Officer, Yaduvendra Kumar, to discuss the growing concerns. To everyone’s shock, the CO allegedly responded rudely and cut the call, saying he “wasn’t here to answer public queries.”

Such behavior by a public servant in a sensitive legal case involving SC/ST Act misuse has only added fuel to the fire.

Rashtriya Savarna Parishad Issues Warning to Authorities

National President of RSP, Pandit Pankaj Dhawariya, has taken cognizance of the case and formally warned Rae Bareli police to quash the “fake SC/ST case” immediately. If the matter is not resolved, a large scale protest and gherao of the SP Office is being planned.

The RSP has urged all its district and state units to mobilize for a peaceful demonstration to seek justice for an economically weak Brahmin family that has allegedly fallen victim to SC/ST Act misuse.

Law or Weapon? The Debate Over SC/ST Act Misuse

The Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act was established to protect vulnerable communities from discrimination and violence. However, there have been growing concerns about SC/ST Act misuse, particularly when false accusations are used to gain economic or social advantage.

This case highlights the darker side of the law’s exploitation, where instead of offering protection, it has allegedly been used to extort land, silence opposition, and cause irreparable mental damage even death.

What’s Next?

The family of Brijesh Pandey demands the withdrawal of the false SC/ST case.

The community has vowed to continue protests if justice is not delivered.

Human rights lawyers and social activists are being contacted to provide legal support to the Pandey family.

Community Reaction

Local residents have expressed disappointment in the Salon Police’s biased conduct and fear that such incidents, if unchecked, will increase caste based tensions across the region.

People ask, “If anyone can be jailed through a fake SC/ST case without proof, then where is justice for the common man?”

Conclusion

The Rae Bareli SC/ST Act misuse case has raised serious questions about law enforcement, caste relations, and legal abuse in land transactions. If police do not take fair and swift action, it could trigger widespread resentment and possibly larger movements from marginalized upper caste communities.

The Rashtriya Savarna Parishad’s planned protest could become a turning point in the broader debate over caste based legal protections and their potential misuse.
